Welcome to ConfyChair. These Terms of Service ("Terms") govern your access to and use of the ConfyChair platform, including any websites, mobile applications, and services offered by PT Berlian Otomasi Teknologi ("we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our platform.

1. Acceptance of Terms

By accessing or using the ConfyChair platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legal agreement between you and PT Berlian Otomasi Teknologi. If you are using the platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

ConfyChair is a comprehensive conference management platform that provides tools and services for organizing academic and professional conferences, including but not limited to abstract and paper submission, peer review management, conference scheduling, registration, and payment processing. The specific features and services available to you may depend on your user role and the specific conference settings.

3. User Accounts

To access certain features of the platform, you may need to create a user account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Create only one account, unless explicitly permitted to create additional accounts
• Not share your account credentials with any third party
• Notify us immediately of any unauthorized use of your account or any other breach of security
• Ensure that you log out from your account at the end of each session when accessing the platform from a shared computer

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

4. User Content

Our platform allows you to submit, upload, publish, or otherwise make available content, including but not limited to text, papers, abstracts, reviews, comments, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you submit to the platform. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and promoting the platform.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• The User Content does not infringe upon the intellectual property rights or other rights of any third party
• The User Content does not violate any applicable law or regulation
• The User Content is not harmful, abusive, unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable

We reserve the right to remove any User Content that, in our judgment, violates these Terms or may harm or offend other users or third parties.

5. Intellectual Property Rights

The platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of PT Berlian Otomasi Teknologi and its licensors. The platform is protected by copyright, trademark, and other laws of both Indonesia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Prohibited Uses

You agree not to use the platform:

• In any way that violates any applicable law or regulation
• To impersonate or attempt to impersonate another person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the platform
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the platform
• To use the platform for any fraudulent or unlawful purpose
• To transmit, or procure the sending of, any advertising or promotional material, including any 'junk mail,' 'chain letter,' 'spam,' or any other similar solicitation
• To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

Additionally, you agree not to:

• Use any robot, spider, or other automatic device, process, or means to access the platform for any purpose, including monitoring or copying any of the material on the platform
• Use any manual process to monitor or copy any of the material on the platform or for any other unauthorized purpose
• Use any device, software, or routine that interferes with the proper working of the platform
• Attempt to probe, scan, or test the vulnerability of the platform or any connected network, or breach security or authentication measures

7. Payment Terms

Certain features of the platform may require payment of fees. All fees are stated in the applicable conference or service description and are non-refundable unless otherwise specified. You agree to provide accurate and complete payment information and authorize us to charge your designated payment method for all fees incurred. We may change our fees at any time, but changes will not apply retroactively to existing paid subscriptions or registrations.

8. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure, that defects will be corrected, or that the platform or the servers that make it available are free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will PT Berlian Otomasi Teknologi, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any content obtained from the platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Indemnification

You agree to defend, indemnify, and hold harmless PT Berlian Otomasi Teknologi, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the platform, including, but not limited to, your User Content, any use of the platform's content, services, and products other than as expressly authorized in these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Bandung, Indonesia for the resolution of any disputes arising from these Terms or your use of the platform.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms.
